WIPO (World Intellectual Property Organization) has confirmed that as of 1 August 2026, Jersey is a separate designation under the Madrid international trademark system. The change applies to both new and existing international registrations.
Previously, designating the United Kingdom in an international trademark registration automatically extended protection to Jersey. Jersey must now be designated separately in an international application or through a subsequent designation. Alternatively, protection can also be sought in Jersey through a national registration.
For existing international registrations where the UK is designated and the registration was in force on 1 August 2026, WIPO will automatically record a separate Jersey designation. After this, the UK and Jersey designations will operate independently of each other.
If the application had not yet been registered in the UK, WIPO will record the Jersey designation only once the application has been accepted for registration in the UK, either in part or in full. If protection has been refused or invalidated in the UK, the Jersey designation will not be recorded.
For international registrations managed by Berggren in which the UK is designated, separate Jersey designations will be created under the respective registrations. This will make it possible to renew the registration in Jersey in due course if protection is to be maintained there.
If a company has business activities in Jersey and needs to protect its trademarks there, the trademarks can be registered either by designating Jersey under an international registration or by applying for a national registration in Jersey.
